Terms of Service

The rules for using REMARQ as a creator or as a brand: what you agree to, what we provide, what it costs, and what happens when something goes wrong.

1. These terms

These terms are an agreement between you and REMARQ ("REMARQ", "we", "us") covering your use of the REMARQ marketplace, website and applications. By creating an account, or by using REMARQ after you have one, you accept them. If you do not accept them, do not use REMARQ.

They sit alongside the Privacy Policy, which explains what happens to your information. Both documents are versioned, and the versions you accepted when you created your account are recorded.

2. Who can use REMARQ

  • You must be 18 or older.
  • If you use REMARQ for a company or another organisation, you must be authorised to accept these terms on its behalf, and "you" then means that organisation as well as yourself.
  • You must not be barred from using REMARQ under the law that applies to you, and you must not have had a REMARQ account closed for a breach of these terms.
  • Access may be limited while REMARQ is in pre-launch: profiles submitted during that period may be placed on a waitlist instead of being released into the marketplace, and released later in the order they were received.

3. Your account

  • Give us accurate information. Your email address must be one you control, and the details on your profile must be true. An account created with someone else's identity, or a profile that misstates who is behind it, may be closed.
  • One account per person or organisation. Accounts are not transferable and cannot be sold.
  • Keep your password to yourself. You are responsible for what happens through your account. Tell us immediately if you believe someone else has access to it.
  • We may restrict an account - warn it, suspend it, or ban it - where these terms are broken, where information is false, where other users are at risk, or where the law requires it. Where it is reasonable to do so, we will say why.

4. If you are a creator

  • The audience figures on your profile must be honest. A connected Instagram or YouTube account is read directly from the platform and is treated as verified; anything you enter by hand is treated as your own claim, and a claim we find to be inflated is grounds for closing the account.
  • Your profile, portfolio and applications must be your own work and your own audience. Do not offer reach you do not have, and do not apply to a campaign you cannot deliver.
  • Once you accept a brand's collaboration request, or a brand accepts your campaign application, you are entering a commitment with that brand. Deliver what was agreed, and tell the brand early if something changes.

5. If you are a brand

  • Describe campaigns and budgets honestly. A campaign must state what it actually needs and what it actually pays.
  • Do not use REMARQ to collect creator data for a campaign that will never run, and do not approach creators on behalf of a business you are not authorised to represent.
  • Once you accept an application or a creator accepts your request, you are entering a commitment with that creator. Honour the brief and the agreed terms.

6. Profile review

REMARQ is not an open directory. Every profile is reviewed by a person before it enters the marketplace, and a profile can be approved, sent back for changes, or rejected with a reason. Review is a check that a profile is complete and credible - it is not an endorsement of anyone's work, and it is not a guarantee about any collaboration.

Review takes time and is done in the order requests arrive. Submitting a profile does not guarantee approval, and approval does not guarantee matches, applications or income.

7. Connecting Instagram or YouTube

  • Connecting an account means authorising REMARQ to read specific information from it - REMARQ requests read-only access and never posts, edits or deletes anything on your behalf.
  • You must be entitled to connect the account you connect. Connecting an account that belongs to someone else is a breach of these terms.
  • You can disconnect at any time from your profile, which deletes the stored access and refresh tokens and the figures read through them. You can also withdraw access from the platform itself.
  • If the platform revokes or expires the connection, the account stops counting as verified until it is reconnected.

8. Matching and discovery

REMARQ ranks creators and brands against each other using signals such as niche, audience size, engagement, location and preferred collaboration type, and shows you the results. The ranking is ours and we may change how it works.

A match or a suggestion is a starting point, not a recommendation or a warranty. REMARQ does not verify the commercial claims anyone makes about themselves, and you should do your own checks before entering into a collaboration.

9. Campaigns, applications and requests

  • A brand sets the terms of its campaign. A creator applies with a pitch. The brand decides who it accepts.
  • A collaboration request is an invitation from one side to the other, with a message. It expires if it is not answered in time, and can be declined.
  • REMARQ is not a party to any collaboration between a creator and a brand. The agreement about deliverables, timelines and payment for the work is between the two of you, and so is settling it. REMARQ does not hold or transfer campaign budgets, and does not mediate payment disputes over work performed.

10. Payments, plans, trials and the connection fee

Plans and prices

REMARQ has a free plan and a paid plan on each side of the marketplace. Creator Basic and Brand Basic are free. Creator Pro is currently ₹199 per month and Brand Pro is currently ₹999 per month, currently offered at a launch price of ₹599 per month. Prices are shown in the app before you pay, and the price shown at checkout is the price that applies - the figures here are a summary and may change, and a change will never apply retroactively to a period you have already paid for.

Trials

Paid plans include a free trial period, currently seven days and available once per account per plan. No payment instrument is taken to start a trial, nothing is charged when it begins, and nothing is charged automatically when it ends - a trial simply expires unless you choose to subscribe.

The connection fee

A creator on a plan that does not include a fee waiver pays a one-off connection fee, currently ₹49, at the point of accepting a brand's collaboration request. Creators on a plan that waives the fee pay nothing, and no fee applies to a request a creator declines or one that expires. The exact amount is shown in the app before you pay it. This fee is for making the connection and is not a share of any campaign budget.

Processing, renewals and cancellation

  • Payments are processed by Razorpay. REMARQ does not receive or store your card, UPI or bank details.
  • Subscriptions renew monthly for as long as they are active. A coupon applied at purchase applies to that purchase.
  • You can cancel a subscription at any time from your subscription screen. Cancelling stops the next renewal and leaves the subscription active until the end of the period you have already paid for.
  • Payments are not refunded, and a partly used period is not refunded on cancellation. This is a statement about how the product works rather than a term we are asking you to agree to for its own sake: there is no refund process in REMARQ, so nothing here should suggest one.
  • If a payment fails or a subscription lapses, the account moves back to the free plan and the paid features stop. Nothing already in your account is deleted because a subscription ended.
  • If we ever charge you in error, tell us and we will correct it - and where the law gives you a right to a refund, these terms do not take it away.

11. What you must not do

  • Break the law, or use REMARQ to help anyone else break it.
  • Misrepresent who you are, who you represent, or what you can deliver - including inflated audience numbers and invented portfolio work.
  • Offer, request or accept payment for fake engagement, followers or views, and use REMARQ to arrange it.
  • Harass, threaten, or discriminate against anyone, or send unsolicited messages about anything other than the collaboration at hand.
  • Post content that is unlawful, infringing, sexually explicit, or that promotes violence or hatred.
  • Scrape, crawl or bulk-collect other users' information, or use REMARQ to build a mailing list.
  • Attempt to break, overload, or gain unauthorised access to REMARQ or another user's account, or work around a limit the platform applies.
  • Copy, resell or impersonate REMARQ, or present your relationship with REMARQ as a partnership or endorsement that does not exist.

12. Content you put on REMARQ

What you post stays yours. Your profile text, portfolio, images, campaign briefs, pitches and messages remain your property, and REMARQ claims no ownership of them.

To operate the marketplace you give REMARQ permission to host, store, display and reproduce that content for the purposes of the platform - showing your profile to the other side of the marketplace, showing an application to the brand it was sent to, showing a message to the person it was sent to, and keeping the records described in the Privacy Policy. That permission ends when the content is deleted or the account is closed, except for copies that are part of a record we have to keep.

You are responsible for what you post, and you must have the right to post it. Content that breaks these terms can be removed.

13. REMARQ's intellectual property

The REMARQ name and logo, the design of the product, the matching and scoring system, and the software behind all of it belong to REMARQ. Nothing in these terms transfers any of that to you, and you may not copy or reuse it without written permission.

If you send us a suggestion about the product, we may use it without obligation to you - we would rather be able to act on good ideas from the people using it than negotiate over each one.

14. Availability and changes to the service

REMARQ is provided as it is. We work to keep it available, but we do not promise uninterrupted service, and features may change, be added, or be withdrawn as the product develops - plan features and limits included. Where a change materially reduces what a paid plan gives you, you can cancel as described in section 10.

We may suspend the service for maintenance, or stop providing it entirely. If we discontinue the service, we will give reasonable notice to the email address on your account.

15. Suspension and closing accounts

You can close your account at any time by asking us - see section 17. We may suspend or close an account that breaks these terms, that we reasonably believe is being used to defraud someone, or where the law requires it. Where we do, and where it is appropriate, we will tell you the reason.

Closing an account does not cancel an obligation you already took on with someone else, and does not entitle you to a refund of a period already paid for.

16. Disclaimers and liability

REMARQ is a place to find each other. It is not a party to anyone's collaboration, does not supervise it, and does not guarantee its outcome. To the extent the law allows, REMARQ makes no warranty about the conduct of any user, the accuracy of anything a user states about themselves, or the results of any collaboration arranged through the platform.

To the extent the law allows, REMARQ is not liable for lost profits, lost opportunities, lost followers or reputation, or for anything a creator and a brand did or failed to do under an agreement between them. Where REMARQ is liable, its total liability for a claim is limited to the amount you paid REMARQ in the twelve months before the claim arose.

Nothing in these terms limits liability that cannot lawfully be limited, and nothing here takes away a right you have as a consumer under the law that applies to you.

17. Changes, governing law and contact

Changes to these terms

These terms are versioned, and the version you accepted when you created your account is recorded. We may update them; where a change is material we will tell you in the app or by email before it takes effect. Continuing to use REMARQ after that means the new version applies.

Governing law

These terms are governed by the laws of India, and any dispute arising out of them or out of your use of REMARQ is subject to the jurisdiction of the courts of India. Nothing in this paragraph prevents either of us from seeking relief in any court that has jurisdiction over the other.

Closing your account, and everything else

To close your account, or for any question about these terms, write to us. See section 8 of the Privacy Policy for what happens to your information when an account is closed.

If any part of these terms turns out to be unenforceable, the rest stays in force. If we do not enforce a term on one occasion, that is not a waiver of it.
